These Terms and Conditions (“Terms”) govern your access to and use of our website and the purchase of digital products offered through VidaDeRogi. By purchasing or downloading any digital product from our website, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our website or purchase our products.

 

1. Digital Products Only

We exclusively sell digital products. No physical goods will be shipped.

 

2. License and Usage

Upon purchase, you are granted a non-exclusive, non-transferable license to use the digital product for personal or internal business use only. You may not resell, distribute, sublicense, share, or otherwise make the product available to any third party.

 

3. No Refunds

Due to the nature of digital products, all sales are final.

Once payment has been successfully completed and access to the digital product has been provided, the order cannot be canceled, returned, exchanged, or refunded.

By purchasing a digital product, you expressly request immediate access to the digital content. Where applicable under your local law, you acknowledge that immediate delivery of digital content may result in the loss of any statutory right of withdrawal once delivery begins.

Refunds will not be granted for reasons including, but not limited to:

  • Change of mind
  • Purchasing the wrong product
  • Incompatibility resulting from failure to review product requirements
  • Lack of knowledge or experience using the product
  • Failure to achieve a desired creative result
  • Differences in appearance caused by camera settings, color profiles, lighting conditions, exposure, white balance, editing software, or workflow
  • Failure to read the product description prior to purchase

Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded under applicable law.

 

4. Product Compatibility

Our digital products are provided “as described” on the product page.

It is the customer’s responsibility to verify compatibility with their software, hardware, operating system, camera, editing application, and workflow before purchasing.

We are not responsible for incompatibilities arising from unsupported software versions, unsupported hardware, incorrect installation, incorrect usage, or failure to follow the provided instructions.

 

5. Creative Products Disclaimer

Products intended for creative use, including LUTs, presets, templates, Powergrades, plugins, and similar digital assets, are artistic tools.

Results will vary depending on numerous factors including camera model, recording format, color profile, exposure, white balance, lighting conditions, editing software, project settings, and user workflow.

Product preview images and videos are examples only and do not guarantee identical results on every project or source file.

 

6. Intellectual Property

All content and digital products sold on this site, including but not limited to text, images, graphics, software, and files, are the property of VidaDeRogi or its licensors and are protected by copyright and intellectual property laws. Unauthorized use is strictly prohibited.

 

7. Account Responsibility

If you create an account on our site, you are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account.

 

8. Product Access

Purchased digital products remain available for download through the customer’s mail account (inbox received e-mail) while technically and commercially feasible.

We reserve the right to update, improve, modify, replace, or discontinue products at any time.

Where practical, customers who have already purchased a product will continue to have access to the version purchased, but we do not guarantee perpetual hosting or unlimited download availability.

 

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use our digital products. Your use of the products is at your sole risk.

 

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law principles.

 

11. Modifications

We reserve the right to change or update these Terms at any time without prior notice. Continued use of the website or purchase of products after such changes constitutes your acceptance of the new Terms.

 

12. Technical Support

We will make reasonable efforts to assist customers experiencing genuine technical issues related to downloading or using a purchased product.

Technical support does not include:

  • Personalized color grading
  • Editing services
  • Training
  • Creative consultation
  • Software unrelated to our products

The inability to achieve a desired artistic result does not constitute a product defect.

 

13. Chargebacks

Customers agree to contact us before initiating a chargeback or payment dispute so that we have an opportunity to resolve any issue.

In the event of a payment dispute, we reserve the right to provide payment processors with documentation including order information, download access records, customer correspondence, acceptance of these Terms, and evidence demonstrating that the purchased digital product was delivered as described.
